Acceptable Use Policy

This Acceptable Use Policy (the "AUP") sets the rules for using cloudmarlin (the "Service"). It is incorporated into our Terms of Service. Violations may lead to suspension or termination of your access without refund.

What you upload#

You may upload a packet capture only if all of the following are true:

  • You captured it yourself, or you have explicit authorization from the owner of the network and from any party whose communications appear in it that is required by applicable law;
  • Uploading it to a US-incorporated service provider that processes data in the European Union does not violate any contract, regulation, or court order that binds you (e.g., classified data, regulated health data outside a HIPAA-compliant arrangement, certain export-controlled material);
  • It does not contain content that is itself illegal to possess or transmit in your jurisdiction.

Prohibited uses#

You agree not to use the Service to:

  • Analyze traffic you obtained through unauthorized interception, intrusion, or other unlawful means;
  • Aid or document an attack on a network, system, or person you are not authorized to attack — including hands-on offensive operations against third parties. (Authorized red-team and penetration-testing engagements with documented scope are allowed.)
  • Upload content that is unlawful, defamatory, harassing, child sexual abuse material, or that infringes intellectual-property rights;
  • Submit malware payloads or other content designed to harm the Service or other users beyond what would normally appear in captured network traffic;
  • Attempt to bypass authentication, rate limits, quotas, or upload-size restrictions, or to gain access to accounts or data that are not yours;
  • Reverse engineer, decompile, or attempt to extract the source of the Service, except where applicable law expressly permits;
  • Resell or sublicense the Service without a written agreement with us, or relabel it as your own product;
  • Run automated scraping, crawling, or load-generating activity against the Service beyond ordinary, documented API use;
  • Use the Service in violation of US export-control laws, including by accessing it from a country or by a person subject to a comprehensive US embargo or on a US restricted-party list.

Fair use of shared resources#

The Service runs on shared infrastructure. Behaviors that degrade availability for other users — for example, sustained large-volume uploads beyond your tier, abuse of the anonymous endpoint to bypass per-account quotas, or denial-of-service-like patterns — are prohibited. We may rate-limit, queue, or reject requests that threaten capacity for other users.

Reporting violations#

To report a violation of this AUP, copyright infringement, or other abuse, email abuse@cloudmarlin.com. For DMCA notices, include the elements required by 17 U.S.C. § 512(c)(3) and direct them to the same address.

Enforcement#

We may investigate suspected violations, including by examining account metadata and, where strictly necessary and lawful, the content of uploads. We may suspend or terminate access, remove content, refer matters to law enforcement, and pursue any remedy available to us. We are not obligated to monitor user activity proactively, and our failure to enforce this AUP in any instance is not a waiver of our right to enforce it later.
